The FMCSA Drug and Alcohol Clearinghouse Rule takes effect January 6, 2020. The rule establishes a secure, federal online database that will give employers, FMCSA, State Driver Licensing Agencies, and State law enforcement personnel real-time information about CDL driver drug and alcohol program violations.
Prospective employers are NOT permitted to allow CDL holders or CLP holders to perform in a safety sensitive function until Clearinghouse query details have been obtained.
CDL holders and CLP holders applying for commercial driving positions MUST register in the FMCSA Clearinghouse to provide electronic consent to release detailed drug and alcohol program violation(s) to a current or prospective employer.
